Copyright Policy

ShareWell respects the intellectual property rights of others and expects members to do the same. This page explains how to report material you believe infringes your copyright, and how a member can respond if their material is removed.

Reporting alleged infringement

If you believe material on ShareWell infringes a copyright you own or are authorized to act for, send a written notice to our designated agent containing all of the following:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work you claim has been infringed.
Identification of the material you claim is infringing, with enough detail for us to locate it, for example the host’s username, the group name, and links or screenshots.
Your contact details: name, postal address, telephone number and email address.
A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Incomplete notices may delay our review. If your notice is missing any of the above, we will tell you what is needed.

Designated agent

What happens next

We review each complete notice and decide whether the material should be removed or access to it disabled. We will tell you the outcome and our reasoning. If we remove material, we notify the member who posted it and provide them a copy of your notice.

Copyright protects original expression. It does not protect ideas, methods, systems, concepts or facts, and similarity of subject matter or approach is not by itself infringement.

Counter-notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to the address above containing:

Your physical or electronic signature.
Identification of the material removed and where it appeared before removal.
A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for any district in which ShareWell may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we will forward it to the person who submitted the original notice. We may restore the material after 10 business days unless we are told that a court action has been filed seeking to restrain the member.

Repeat infringers

We terminate the accounts of members who repeatedly infringe the copyrights of others, in appropriate circumstances. See our Terms & Conditions.

Misrepresentation

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages, including costs and legal fees.
