At ShareWell Labs Co. (“ShareWell”, “we”, “our” and “us”), we appreciate the trust you have placed in us with regard to your privacy. This Privacy Policy explains how ShareWell collects, uses and discloses personal information we obtain in connection with our provision of services through our website or mobile application or other online services that link to or refer to this Privacy Policy (collectively, the “Services”).

It is important that you read this Privacy Policy carefully because any time you use our Services, you consent, on your own behalf, to the practices we describe in this Privacy Policy.

How we collect your information

Information You Provide

We collect any information that you provide us when you use the Services, when you communicate with our team, or when requesting additional information from or about our Services.

For example, we collect:

• Your contact information and other identifiers, such as your name, phone number, and email address.
• Other information you provide when you register, complete your profile, sign up for a group, or leave a review, such as your user name, profile picture, information about your story, what brought you to our Services, what you hope to contribute and gain, and information about groups you have hosted or attended.
• Payment information, including payment card information, billing address, and other financial information. Please note that we use third-party payment processing providers, including Stripe, to process payments made to us. We do not retain any personally identifiable financial information, such as payment card number, that you provide to these third-party payment processing providers in connection with payments. Rather, all such information is provided directly by you to our third-party payment processing providers. • Any information you share when you contact us directly for feedback, support, or any other reason.
• Content from groups. We generate written transcripts of groups using the live-captioning feature of our video service providers, and we temporarily store those transcripts to support member safety and service quality. We tell you before every group that it will be transcribed, and joining indicates your agreement. We do not record or store audio or video of groups.

Information We Collect Automatically

We collect information about how you access and use our Services when you engage with us. We collect this information primarily through our own first-party technologies, such as first-party cookies and our own analytics system, which runs on systems we control. For example, we use cookies to keep you signed in, remember your cookie preferences, hold an anonymous analytics identifier, and record which version of a page you were shown when we test improvements.

A small number of service providers, such as our payment and video providers, may also receive technical information from your device when they perform their function for us. We also use UserJot, a third-party feedback service, to collect product feedback and feature requests. If you are signed in, UserJot receives your username, email address, and profile picture so that we can follow up with you about your feedback. UserJot loads unless you decline optional cookies and scripts, and you can decline or withdraw at any time using the cookie banner.

Examples of automatically collected information include:

• Device and Usage Information. We may receive information from your device, including the IP address, mobile operating system version, and unique device identifiers. We may also collect and store your browser and app settings and preferences.
• Online Activity. We may receive information about your interactions with our Services and other electronic and network activity information, such as the time spent interacting with content and the dates and times of your visits.
• Geolocation Information. We may obtain information about your physical location, such as when you use the geolocation features in your device.

Information we collect automatically about you may be combined with other personal information we collect directly from you.

For information about the choices you may have in relation to our use of automatic data collection technologies, please refer to the “Your privacy choices” section below.

Other Information

Information from Other Sources. We may obtain information from third parties and sources other than the Services, such as from our sponsors and advertisers.

Information from Other Users. We may receive information about you from our other users. For example, a user may leave a review on your account if you host a support group.

We may combine the information we collect about you from different sources, including to generate inferences, to help us enhance and improve our products and services, and tailor our communications to you.

How we use your information

We generally use the information we collect for the following business purposes:

• Provide, customize and improve our products and services. For example, we use the information we collect about you to provide the Services, to improve and develop new products, services, features and functionality and to understand and analyze the usage trends and preferences of our users. We also use your information to monitor and analyze usage and the effectiveness of the Services and marketing activities.
• Communicate with you about our products, services, and promotions. For example, we may send emails to the email address you provide to us for operational purposes, such as account management or customer service. We may also use your information to send you promotional communications by email. If you prefer not to receive such promotional communications from us, you may opt-out by following the instructions included in those communications.
• Comply with applicable law and enforce our legal rights. We may also process the information we collect about you or from you for the following purposes: (i) to enforce our terms and other legal rights, including intellectual property rights; (ii) to comply with or address applicable law, regulations, or legal processes, such as a court order or subpoena; (iii) in response to requests by government agencies, such as law enforcement authorities; and (iv) to comply with industry standards and our policies.
• Create aggregated, anonymized, or de-identified information that cannot be reasonably used to identify you, which we may use for purposes outside the scope of this Privacy Policy.
• Otherwise with your consent or as described to you at the time of collection.

Third parties with whom we share your information

• Service Providers. We work with third-party service providers who provide development, hosting and other services. These third parties may have access to or process information you provide and information we collect automatically in connection with providing us these services.
• Business Transfers. We also reserve the right to transfer information you provide and information we collect automatically to advisors, potential transactional partners or other third parties in connection with the consideration, negotiation or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate or transfer all or a portion of our assets or in the unlikely event of a bankruptcy.
• Other Users. We make available personal information that you choose to share with other users via our Services. Please keep in mind that the users who view user-generated content may reshare or redistribute the content both on and off our Services or save or copy the content outside of our Services.
• Partner Organizations. Some communities on ShareWell are run together with nonprofit partner organizations and are labeled with the partner’s name. If you join a partner organization’s community, register for or attend its Groups, or answer the intake questions it asks, we share with that organization the information it needs to run its peer support program, such as your username and email address, your phone number if you have provided one, your registration and attendance in its communities, and your responses to its intake questions. Partner organizations are independent from ShareWell, and their use of this information is governed by their own privacy practices. We ask for your agreement before you join a partner community. We do not share your private messages, session transcripts, payment information, or your activity outside that organization’s communities.
• Other Parties as Required by Law or as Necessary. We may disclose information you provide and information we collect automatically about you: (i) if we are required to do so by law, regulation or legal processes, such as a court order or subpoena; (ii) in response to requests by government agencies, such as law enforcement authorities; (iii) when we believe disclosure is necessary or appropriate to protect against or respond to physical, financial or other harm, injury or loss to property; (iv) in connection with an investigation of suspected or actual unlawful activity; (v) to protect the health and safety of us, our users, or any person; (vi) in connection with the establishment, exercise, or defense of legal claims; or (vii) to protect our rights and property and the rights and property of our agents, users, and others, including to enforce our agreements, policies, and terms of use.
• With Your Consent. We may share information you provide and information we collect automatically for other purposes with your consent or at your direction.

Third party services

We also may use or make available to third parties information you provide and information we collect automatically in a manner that does not identify you or has been aggregated. For example, we may share aggregated information with third parties that sponsor usage of the Services.

Advertising Partners

When you create an account or first subscribe after clicking one of our ads on a third-party platform, we report that conversion to the platform that showed you the ad (such as Meta and Google) so we can measure whether our advertising works. These reports contain the ad click identifier set by the platform, your browser type, the page on our site where it happened, the date and time, and, for subscriptions, the amount. We have taken steps to ensure that the reports don’t include your name, email address, or phone number, and that they are sent from our servers, not by code running in your browser. You can turn this sharing off at any time in your account settings. You can also ask us to turn it off by emailing [email protected].

How long we keep your information

Your account and the records needed to provide the Services, such as your profile, your group participation history, your messages and reviews, and your subscription and payment records, are kept for as long as your account is active. If you ask us to delete your information, these records are handled as described under Data Deletion Requests.

Separately from your account records, we keep analytics records: our own measurements of how the Services are used. Analytics records older than 12 months are de-identified: we permanently remove account identifiers, contact details, IP address, device identifiers, and profile text from them, and strip identifying parameters from page addresses. After that, they are statistics that are no longer connected to you or your account. This de-identification applies only to our analytics records; it does not delete or change anything on your account.

Profile snapshots held in the analytics system are deleted after 12 months. Your actual profile on your account is unaffected.

The raw technical event records behind our analytics are deleted within 90 days of processing.

Group transcripts are stored temporarily as described above.

We may retain some information longer where required for legal, regulatory, security, or payment purposes.

Do-Not-Track and Global Privacy Control

Our Services honor the Global Privacy Control (GPC) signal. If your browser sends the GPC signal, we treat it as a request to opt out of ad conversion sharing: no advertising click identifiers are collected from your visit, and if you create an account while the signal is active, ad conversion sharing is turned off on your new account from the start. You can review or change this at any time in your account Settings.

Children’s privacy

We prohibit anyone under the age of 18 from using or accessing our Services. We do not knowingly collect information online from children under the age of 18. If ShareWell becomes aware that any person submitting information to the Services is under the age of 18, we will promptly take steps to delete any personal information collected in accordance with applicable law.

Changes to our privacy and practices

This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our information practices or relevant laws. To inform you of any change, we will post the updated Privacy Policy on the Services and indicate at the top of the Privacy Policy when it was updated.

Your privacy choices

You can stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in any of our email communications. Please note you cannot opt-out of service-related email communications (such as account verification, transaction confirmation, or service update emails).

You can decline optional cookies and scripts using the cookie banner, and you can turn off ad conversion sharing in your account Settings as described above in the “Advertising Partners” section.

Data Deletion Requests

You may request deletion of your personal information at any time. To request that we delete any data we have collected about you, including data obtained through third parties, please contact us at [email protected].

Upon receiving your request, we will verify your identity and delete your personal information from our systems within the timeframe required by applicable law. Some data may be retained for legal, regulatory, or security purposes in compliance with applicable law.

Updates to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the effective date on this page. All changes shall be effective from the date of publication unless otherwise provided.
